Terms of service
These Terms of Service govern the use of the Ever Leaf website and the terms for purchasing the products offered on it. Placing an order on the website constitutes agreement to the terms set out in these Terms of Service.
Any use of a specific grammatical gender in these Terms is for convenience only and refers equally to all genders.
1. About Ever Leaf
Ever Leaf is a business specializing in the design and handcrafted production of personalized lamps, combining a real natural leaf, personal engraving based on a photograph uploaded by the customer, epoxy casting, and an electrical lighting component. Each product is manufactured specifically for the customer based on the photograph and personalization details they provided.
Some of the materials or components used in manufacturing the product may be manufactured or purchased outside Israel; however, the personalization process and final assembly of the product take place in Israel.

2. The Product – Natural Materials and Handcraftsmanship
The product combines a real natural leaf, epoxy casting, and handcrafted components. As a result, reasonable variations may exist between products, including in the leaf's color, vein pattern, shape and size, texture, and handcrafted finish, as well as other minor visual characteristics. Such variations, resulting from the natural and handmade nature of the production process, do not in themselves constitute a defect in the product.
For the avoidance of doubt, the foregoing does not derogate from the customer's rights in the event of an actual manufacturing defect, a personalization error made by Ever Leaf, a material mismatch between the product received and the order confirmed, or damage that occurred during shipping, as detailed in the Refund, Cancellation & Returns Policy.
Product images shown on the website are for illustration purposes only, and slight differences may exist between the image and the actual product, resulting from the natural character and personalized nature of each product.
3. Price and VAT
Prices displayed to the customer on the website include VAT as required by law. Where a shipping fee is charged, the shipping cost will be shown to the customer separately, before the order is completed, as detailed in the Shipping Policy.
4. Order and Personalization Process
Purchasing a product on the website involves the following steps:
- The customer uploads a photograph and sets the personalization details using the website's personalization tool.
- Before completing the order, the customer is shown a preview of the personalization.
- The customer completes the order and makes payment.
- After the order is placed, Ever Leaf internally reviews the photograph and the personalization details provided.
- If the materials are suitable, Ever Leaf internally approves the order for production.
- Production begins only after this internal approval.
For clarity: the preview shown to the customer during the ordering stage does not itself constitute the start of production. Production start is defined as the point at which Ever Leaf has completed its internal review of the personalization materials and approved the order for production, as detailed in the Refund, Cancellation & Returns Policy.
If the uploaded photograph or personalization material is found to be unsuitable for producing an appropriate result, Ever Leaf will contact the customer and request a replacement photograph or material. In such a case, production will be paused until suitable material has been received and internally approved, and the production time specified in the Shipping Policy will only begin counting from that point.
The level of detail and the final result of the product depend, among other things, on the quality of the photograph provided by the customer. However, where Ever Leaf identifies a clear technical problem with the photograph or uploaded material before production begins, it will contact the customer as described above, and will not proceed to production based on material identified as unsuitable without first contacting the customer.
5. Order Confirmation
Placing an order on the website constitutes an offer by the customer to purchase the product. An automatic confirmation sent to the customer upon placing the order constitutes technical acknowledgment of receipt only, and does not constitute a final commitment by Ever Leaf. In exceptional cases — such as a material and obvious error in the product description or price — Ever Leaf may decline to confirm an order or may cancel it, in which case the customer will be refunded the full amount paid.
6. Legal Capacity
Use of the website and placing orders are intended for individuals aged 18 and over. A minor wishing to make a purchase requires the prior consent of a parent or legal guardian.
7. Payment
Payment on the website is made using one of the payment methods available on the website at the time of ordering. Payment-instrument details are processed by external payment and clearing providers, and Ever Leaf does not itself store the customer's full payment-instrument details.
8. Cancellation of a Transaction
The policy governing cancellation of a transaction, including the distinction between cancellation before production start and cancellation after production start, as well as the handling of cases involving a defect, a personalization error, or shipping damage, is set out in full in the Refund, Cancellation & Returns Policy, which forms an integral part of these Terms.
9. Warranty on the Lighting Component
Ever Leaf provides a 12-month warranty, from the date the product is received, covering the lighting/electrical component (LED) only, against a genuine manufacturing defect or functional defect arising under normal, intended use. The warranty does not cover accidental physical damage, misuse, repair or modification carried out by anyone other than Ever Leaf, connection to an unsuitable power supply, damage caused by water or moisture to a product not designed for such exposure, or normal wear and tear. The product's electrical system operates via a USB connection and a wall power adapter.
This commercial warranty does not derogate from any right that cannot be limited or excluded under applicable law.
10. Customer-Uploaded Content and Rights in the Photograph
The customer represents and warrants that they own the rights to the photograph they upload for the purpose of personalization, or have obtained the consent required to use it for that purpose, and that uploading or using it does not infringe the rights of any third party. Responsibility for content uploaded by the customer, including any copyright and privacy rights associated with it, rests with the customer.
11. Intellectual Property
The website, product designs, logo, and all content on the website are the property of Ever Leaf, and may not be copied, reproduced, or used commercially without prior written permission.
12. Prohibited Use of the Website
The website may not be used for any unlawful purpose, to provide false details, to upload content that does not belong to the user or that infringes the rights of a third party, to interfere with the proper operation of the website, or to bypass its security measures. Ever Leaf may decline to fulfill an order or may cancel it if there is reasonable concern that this provision has been violated.
13. Limitation of Liability
The content of the website is provided "as is." Ever Leaf works to ensure that the information on the website is accurate and up to date; however, inadvertent inaccuracies may occur. To the extent permitted by law, Ever Leaf will not be liable for indirect damage arising from use of the website, without derogating from its liability under law for products sold or from the customer's non-waivable statutory rights.
14. Governing Law and Jurisdiction
Use of the website and any transaction carried out on it are governed by Israeli law. Any dispute shall be subject to the jurisdiction of the competent courts in Israel, without derogating from any right of the customer under law.
15. Changes to These Terms
Ever Leaf may update these Terms from time to time. The version binding on an order is the version published on the website at the time the order is placed, and an update to these Terms will not apply retroactively to orders placed before it.
