Protecting customer privacy matters to Ever Leaf. This Privacy Policy explains what information is collected when you use the website and place orders, why it is collected, how it is used, and with whom it may be shared. This Privacy Policy operates in accordance with the Privacy Protection Law, 5741-1981, as amended.

2. Information Collected

When placing an order on the website, the customer provides the information required to complete it, including name, contact details, shipping address, and order details. For the purpose of creating the personalized product, the customer uploads a photograph and provides additional personalization details, as relevant.

Providing this information is not a legal requirement. However, without the details reasonably necessary for processing the order, carrying out the personalization, communicating with the customer, production, and shipping, it may not be possible to complete the order or supply the product. Ever Leaf will process, for these purposes, only the information reasonably necessary to achieve them.

Payment details themselves are processed by external payment and clearing providers (as detailed in Section 6 below). Ever Leaf does not itself store the customer's full payment-instrument details.

In addition, to the extent required for the website's ongoing and proper operation, the e-commerce platform through which the website operates may process technical information relating to use of the website, such as shopping-cart data, browsing session data, and operational cookies.

3. Use of the Customer's Uploaded Photograph

A photograph uploaded by a customer is collected and used solely for the purpose of creating and supplying the personalized product ordered.

Ever Leaf does not use customer-uploaded photographs for advertising, social media, a portfolio/gallery, or any other marketing material, unless separate, explicit consent has been obtained from the customer for that purpose. Uploading a photograph in order to place an order does not, in itself, constitute consent to such marketing use, and the two purposes — order fulfillment versus marketing use — remain entirely separate.

Ever Leaf does not set a fixed, predetermined retention period for customer-uploaded photographs. The photograph and personalization details are retained only for as long as reasonably necessary for: producing and fulfilling the order; providing customer service; handling a replacement, remake, warranty matter, or complaint; other legitimate operational needs of the business; and complying with Ever Leaf's obligations under law (including recordkeeping obligations, where applicable).

A customer may contact Ever Leaf to request deletion of an uploaded photograph. Ever Leaf will honor such a request wherever reasonably possible, except where continued retention is reasonably required for: handling an active order; an in-progress replacement or remake; an open warranty or service matter; a dispute or claim; compliance with a legal obligation; or another legitimate operational need permitted by law. In such cases, deletion may be delayed until the relevant need has concluded, and will not necessarily be immediate.

4. Purposes of Using the Information

Personal information is used by Ever Leaf to supply the product, manage the order, provide customer service, and respond to inquiries, as well as — subject to separate consent — to send updates and marketing content.

5. Newsletters and Marketing

Where the customer has given explicit consent, Ever Leaf may use the contact details provided to send updates and marketing content from time to time. The customer may request at any time that the use of their details for marketing purposes be stopped, including via an unsubscribe link in a marketing message or by emailing us.

6. Disclosure of Information to Third Parties

To operate the business and complete orders, Ever Leaf may share information with the following third parties, each receiving only the minimum information necessary to perform its role:

  • Payment and clearing providers — for processing payment when an order is placed. As of the date this Policy was published, the website works with PayPlus, PayPal, and Bit as payment/clearing methods. Ever Leaf itself does not store the customer's full payment-instrument details.
  • The e-commerce platform — the system through which the website operates and orders are managed, including the technical processing required for its proper operation.
  • The shipping company/carrier — for delivering the order to the customer.

Ever Leaf does not sell or trade in its customers' personal information. Beyond the third parties listed above, Ever Leaf may also share information with additional service providers where reasonably required to operate the website, fulfill orders, maintain information security, or comply with obligations under law, and where required by law, court order, or to protect its legal rights. In every case, only the minimum information necessary for the recipient to perform its role will be provided.

As of the date this Policy was published, no additional advertising or marketing-analytics tools (such as advertising-network pixels) have been intentionally connected to the website. Should this change in the future, this Policy will be updated accordingly.

7. Cookies

The website uses cookies required for its ongoing operation (such as managing the shopping cart and browsing session) and to improve the user experience. Cookies can be blocked via browser settings, although doing so may impair the proper functioning of some of the website's services.

The customer may contact Ever Leaf to request access to the information held about them, to correct inaccurate information, to request its deletion, or to be removed from the mailing list. Ever Leaf will respond to such requests wherever reasonably possible and in accordance with law, including subject to its recordkeeping obligations (for example, bookkeeping records) and the circumstances described in Section 3 above.

9. Minors

The website is not intended to knowingly collect information from minors under the age of 18 without parental or guardian consent. If Ever Leaf becomes aware that such information has been provided, it will act to delete it promptly.

10. Data Retention Period

Personal information is retained for as long as it is required for the purposes for which it was collected, or as required by law (including recordkeeping obligations), and is thereafter deleted or de-identified. For customer-uploaded photographs and personalization details, see the specific clarification in Section 3 above.

11. Information Security

Ever Leaf employs reasonable, generally accepted security measures to protect the personal information provided to it. Payment-instrument details are processed and secured by the payment and clearing providers, and Ever Leaf does not itself store the customer's full payment-instrument details. Nonetheless, absolute immunity from unauthorized access resulting from unlawful third-party conduct cannot be guaranteed.

Ever Leaf may update this Policy from time to time. The updated version will be published on the website and will take effect from its date of publication.
